F. To make a residual gift (after other specific bequests are made):

G. To make a gift contingent on a spouse:
I give and bequeath the residue of the property owned by me at my death, both real and personal, and whatever situate, to my wife (or husband), (name of spouse), if he (she) survives me. If my wife (or husband) do not survive me, I give my residuary estate to the Society of St. Vincent de Paul, Council of Orange, a non-profit corporation, located at 1505 E. Seventeenth St., #109, Santa Ana, CA, 92705, for its general purposes.

H. To make a contingent on other beneficiaries:
I give and bequeath the residue of the property owned by me at my death, both real and personal, and whatever situate, in equal shares to my above named beneficiaries, if they survive me. If my above named beneficiaries do not survive me, I give my residuary estate to the Society of St. Vincent de Paul. Council of Orange, a non-profit corporation, located at 1505 E. Seventeenth St., #109, Santa Ana, CA, 92705, for its general purposes.

I. To establish a testamentary trust or annuity:
A testamentary trust or annuity may be established to provide income to a survivor for the survivor’s lifetime, with the principal transferring to the Society of St. Vincent de Paul upon the survivor’s death. Sample forms to help your attorney draft this trust are available upon request.

Life Income Gifts: You irrevocably transfer some assets to the Society now, and in return, you (and a survivor, if you wish) receive income for life.

Life Insurance

Some of our supporters no longer need their life insurance that was purchased years ago to provide for children or other family members, and donate the policy to the Society. Gifts can be given to the Society of St. Vincent de Paul through your insurance policy. There are several methods to make such gifts. Since financial contracts such as life insurance can pass to a beneficiary by contract, it would be best for you to contact your life insurance company, and obtain a change of beneficiary form. On that form you can name the Society of St. Vincent de Paul as a beneficiary, or contingent beneficiary, or as the owner, or one of the owners of your life insurance policy. If you do not currently have an insurance agent to help you make this change, you may contact us at 714-542-0448 and we will help you obtain the proper change of beneficiary or change of ownership forms. Whenever you make a change in the residuary designations on your life insurance, we would very much appreciate it if you would give us a copy of the form. That will provide us with an opportunity to thank you for your continued support for the mission of the Society of St. Vincent de Paul, and enable us to be prepared for an orderly intake of future gifts.

Charitable Lead Trusts

Individuals with very large estates can use a charitable lead trust to benefit the Society and to pass principal to family members with little or no tax penalty. It works like this: You transfer assets to a trust that provides payments to the Society for a term of X years. Then the trust principal goes to your children, grandchildren, or others free of, or at greatly reduced, federal gift and estate tax.

(Please note that a generation skipping tax [GST] is imposed on large transfers to grandchildren and others who are more than one generation younger than you.)

Retirement Plans

Gifts of Retirement Plans. Many individuals today have large qualified retirement plans such as an IRA, 401(k), or Keogh plan. These assets have been growing tax-free for years. Once the owner begins to receive payments from the qualified plans, the distributions are taxed. The plans are also included in the owner’s taxable estate. A retirement plan may be an excellent source of funds for making a gift to the Society.

One way to make a gift of your retirement plan is to create a charitable remainder trust through your will. It works like this: Your IRA assets will be transferred to a charitable remainder trust. There is no tax due because the charitable remainder trust is a tax-exempt entity. The trust will provide life income to the beneficiary (for example, your child) with an eventual gift to the Society. The beneficiary will pay income tax on the distributions from the trust. Your estate will receive an estate tax charitable deduction for the value of the Society’s right to eventually receive the trust assets. Since financial contracts such as individual retirement accounts can pass to a beneficiary by contract, it would be best for you to contact company holding your IRA, and obtain a change of beneficiary form. On that form you can name the Society of St. Vincent de Paul, Council of Orange, as a beneficiary, or contingent beneficiary of your IRA.
